Notice on Foreigner Applying

 for Visa

I. Application Object

  After the foreigner arrives in China and needs to stay in China due to non-diplomacy/ official issue, it may apply for visa extension, renew, reissue and stay certificate issue, renew, reissue and resident certificate issue, extension, renew & reissue at the public security organization exit & entry management organization according to regulation.

II. Application Organization

  Foreigner should apply for visa certificate at the public security organization exit & entry management organization above county level entrusted by Ministry of Public Security.

III. Application Method

  If foreigner apply for visa, residency certificate & remain certificate extension and renew, it should handle related formality at the public security organization exit & entry management organization. If one of the following situations happened, it may invite organization, individual, applicant’s parent or related special service organization to handle it on behalf.

1Under 16 years old or more than 60 years old and disabled due to illness and other reasons;

2It is not the first time to entry and has good records of residency in China;

3Invite organization or individual to provide safeguard measure on the needed cost of the foreigner stayed at China.For the foreigner apply for residence certificate, it should handle related formality at the public security exit & entry management organization. If the person belongs to the high level talent needed by the country, emergency special talent and meets the item 1 condition in the previous article, it may invite organization, individual, applicant’s spouse, related special service organization to apply on behalf.

IV. Organization Recording

  The organization which invite or entertain the foreigner may apply for recording at the local public security exit & entry management organization.

V. Application Formality

  When the foreigner applies for visa certificate, it should accept the related inquiry by the public security exit & entry management organization. Public security exit & entry management organization needs to verify the related information of the inviting company (individual). Related organization (individual) should be cooperative. If the applicant or the related organization doesn’t attend the interview at the agreed time regulated by the public security exit & entry management organization notice without justified reason, the public security exit & entry management organization may not issue the visa certificate according to law.

  When the foreigner applies for visa certificate, it should submit the valid passport or other international travel certificate. Write the Foreigner Visa Certificate Application Form, submit a photo which meet the requirement and proof document related to the issue.

VI. Acceptance Receipt

For the visa certificate application which meets the acceptance condition after verification, public security exit & entry management organization should accept and issue acceptance receipt and make decision of whether  issue it within the acceptance receipt valid period. The accept receipt valid period of the visa and stay certificate application shall not exceed 15 working day since the acceptance date.

  When the applicant’s passport or other international travel certificate is withdrew, it may legal resident in China with the acceptance receipt; If  with cogent reason, it may apply for get the passport or other international travel certificate temporarily at the public security exit & entry management organization. But it should give it back within the valid period of the acceptance receipt and should not influence the public security exit & entry management organization to issue related visa certificate.

VII. Required Certify Document for Visa Extension Application

  If the foreigner apply for extend the visa residence period, it should apply for it at the public security exit & entry management organization 7 days before the validity date noted in the visa. It should also submit related application certify document according to the requirement.

1For the C visa holder, it should submit certify letter issued by People’s Government department in charge above the county level, local civil aviation, railway, highway, port and other transportation company. It may extend the residence period for no more than 30 days.

2For F visa holder, it should submit certify letter issued by invitation / entertain company. For the unrecorded company, it should submit register certificate. It may extend the stay duration for no more than 180 days.

3For G visa holder, it should submit the certify letter of the entertain company, confirmed date of the arriving country (region), seat airport (car, ship) ticket. It may extend the stay duration for no more than 30 days.

4For J2 visa holder, it should submit certify letter issued by provincial level people’s government foreign affair department. It may extend the stay duration for no more than 30 days.

5For L visa holder, it should submit travel plan. Group travel should submit travel agency certify letter. It may extend the stay duration for no more than 30 days.

6For M visa holder, it should submit certify letter issued by the local invitation, entertain company or individual. The unrecorded company should submit register registration certificate. If the partner is individual, the issued letter should be signed and submit local permanent household certificate or actual residence certificate. It may extend the stay duration for no more than 180 days.

7For Q 2 visa holder, it should submit the letter, identification certificate & family membership certificate issued by the visited person. It may extend the stay duration for no more than 180 days.

8For R visa holder, it should submit the certify letter of invitation/entertain. The unrecorded company should submit registration certificate. It may extend the stay duration for no more than 180 days.

9For S2 visa holder, the relative visiting person should submit the letter, foreigner residence certificate and family membership certificate issued by the visited person. Other person should submit the related proof of handling the personal affairs or other humanity reason. For the relative visiting person, it may extend the stay duration for no more than 180 days. For other person, it may extend the stay duration for no more than 90 days.

10 For X2 visa holder, it should submit the study certify letter issued by the education/training organization in China. It may extend the stay duration for no more than 180 days. When extending the visa stay duration, it should not exceed the former noted stay duration.

VIII. Required Document for Visa Renew Application

1 It should give convenience of entry if the foreigner in accord with the state regulation and needs to change the stay reason. It should submit the following certify document if it needs to apply for regular visa renew due to sub-group with objective reasons after entry China with group visa and new passport renew.

1.When apply for F visa renew, it should submit the certify document issued by the inviting organization. It may renew the entry validity period of no more than 1 year and extend the stay duration for no more than 180 days for zero time, one time, two times or multiple. For the foreigner high-level talent and investor accord with the national regulation, it may renew the entry validity period of no more than 5 years and extend the stay duration for no more than 180 days.

2. When apply for J2 visa, it should submit the certify document provided by the provincial level people’s government foreign affairs department.  It may renew the entry validity period of no more than 30 days for zero time.

3 .When apply for M visa, it should submit certify document provided by the inviting company. It may renew the entry validity period of no more than 1 year and extend the stay duration for no more than 180 days for zero time, one time, two times or multiple.

4 .When apply for Q2 visa renew application, it should submit the letter, identification proof and family member relationship proof provided by the visited person. It may renew the entry validity period of no more than 1 year and extend the stay duration for no more than 180 days for zero time, one time, two times or multiple.

5. When apply for renew the R Visa, it should provide required evidentiary material according to the condition & requirement for Foreigner High-level Talent & Urgent Professionals Introduction confirmed by China government competent department and certify letter issued by the invitation & host organization. It may renew the visa for zero, one time, two times or multiple times with the detention period within 180 days and entry validity within 5 years.

6. When apply for S2 visa, the family visiting personnel should submit letter issued by the visited person, foreigner residence certificate and family relationship certificate. Other persons should submit related certify material which has humanitarian reasons. It may renew the visa for zero or one time with the detention period within 180 days and entry validity within 3 months.

7 . When apply for renew X2 visa, it should submit letter, admission or entrance certificate issued by the education or training organization within China. It may renew the visa for zero, one time, two times with the detention period within 180 days and entry validity within 1 year.

2If the foreigner needs to renew the passport due to expired passport or exhausted visa pages, it should submit the passport of entry in this time or related certificate of taking back the passport of entry issued by embassy and consulate located in China. It may renew the visa which is same with the original visa type, entry validity, detention period and remained entry times.

3If foreigner adds accompanying person after entry, it should submit the held passport of entry in this time and the birth certificate of the accompanying person. It may renew the visa according to the above-mentioned regulation of the present article.

4When foreigner holds group visa to entry and apply for stay by sub-group, it should submit reception travel agency certify document and so on. It may renew it according to the above-mentioned regulation. The detention period of the renewed visa shall be no more than 1 year continuously since the date of entry in this time.

IX. Required Certify Document for Visa Reissue Application

   If the foreigner applies for reissuing visa due to visa loss, damage, stolen or robbery, it should submit the following certify document:

1 If the visa is lost or rubbed, it should submit passport loss report certificate, note of the embassy & consulate in China, new valid passport or other international travel certificate.

2If the visa is damaged, it should show the damaged passport, note of the embassy & consulate in China, new valid passport or other international travel certificate.

3If the group visa is lost, rubbed or damaged, it should submit the reception travel agency certificate letter and group visa copy. It may reissue the visa which is same with the original visa type, entry validity, detention period and remained entry times.

X. Required Certify Document for Stay Certificate Application

1The foreigner who entry by exemption of visa and needs to continue staying by exceeding the visa free period due to non-diplomacy & non-official business, it should submit related certify material according to the regulation in Article 7 of the notice. It shall issue the stay certificate of related period. 

2If the foreigner sailor and accompanying family member needs to leave the port city which the ship is located, it should submit seaman’s book, other international travel certificate, guarantee letter of the ship agency company, confirmed date & seat airplane (car, ship) ticket or other certify document related with the stay reasons. It may issue the stay certificate with the stay certificate with the detention period less than 30 days.

3If it is approved to quit the Chinese nationality and needs to stay at China, it should submit the nationality quit certificate of China, foreign passport, other international travel certificate and certify document related with the stay reasons. It may issue stay certificate with the detention period less than 180 days.
